After some more testing I came to these conclusions:

If there is no previous RECORD.MP3 the file is created and recording
starts..

If there was a RECORD.MP3 file and it is deleted through windows the
next record attempt fails with:
*PANIC* Updating reserved FAT entry 0

If there is an existing RECORD.MP3 which is not 0bytes the next
record attempt fails with:
*PANIC* timeout 0

To my surprise I was able to actually record a full 80 minutes CD
with the 23:40 bleeding edge build..... once
a second atempt ended in a (by now) predictable timeout panic.

I am trying again now after which time I will go to sleep no matter
what the outcome and I will get back on this topic later ;) I will
also see what happens if I do not delete the RECORD.MP3, but
rename it instead..

All tests are line-in, 48 KHZ, mono
Stereo fails in any case, I always end up with a 32KHz file..
