Yes, they should fix this bug. However, I don't expect them to release
any new firmware for old iPods.

The initial battery level can be inaccurate (both with the original
firmware and with Rockbox). Initial measurements are taken during hard
drive activity, and that extra current temporarily decreases voltage.
If the level doesn't go up after a few minutes, then I agree that it
seems the iPod didn't sleep properly.
